Text Messaging Terms

Effective Date: July 31, 2026

These Messaging Terms & Conditions (“Messaging Terms”) apply when you provide a mobile telephone number, initiate a text conversation, request text messages, or otherwise consent to receive SMS or MMS communications through messaging technology provided by DealerRock, LLC (“DealerRock,” “we,” “us,” or “our”).

DealerRock provides communication technology to boat, recreational vehicle, powersports, and other dealerships and businesses that use the DealerRock platform (each, a “Dealership”).

When you communicate through a DealerRock-powered website widget, messaging tool, or other DealerRock messaging feature, the applicable Dealership is generally the sender of the communications and determines the purpose and content of those communications. DealerRock provides the technology used to facilitate, transmit, receive, store, and manage those communications.

By providing your mobile telephone number and submitting a request to receive text messages through a DealerRock-powered messaging feature, you consent to receive SMS or MMS communications from the Dealership identified at the time you provide your number.

These communications may relate to the inquiry, request, transaction, or relationship you initiated, including communications concerning:

  • Product or inventory inquiries;
  • Sales inquiries and follow-up;
  • Appointments;
  • Quotes or estimates;
  • Service or repair activity;
  • Work order status;
  • Parts inquiries;
  • Invoices or payment requests;
  • Deal or transaction status;
  • Customer-service requests; and
  • Other communications reasonably related to your request or relationship with the Dealership.

Your consent applies to communications from the Dealership identified when your consent is provided. Providing consent to one Dealership does not provide consent for other DealerRock customers or unrelated businesses to contact you.

2. Promotional and Marketing Messages

Submitting an inquiry or initiating a conversation does not, by itself, provide unlimited consent to receive unrelated promotional or recurring marketing text messages.

Where a Dealership requests consent to send promotional or marketing text messages, additional disclosures or consent may be presented to you.

Promotional communications may include:

  • Sales announcements;
  • Product promotions;
  • Special offers;
  • Events;
  • New inventory announcements;
  • Marketing campaigns; and
  • Other promotional communications.

Where required, consent to receive promotional or marketing text messages will be obtained separately and will not be a condition of purchasing goods or services.

3. Message Frequency

Message frequency varies depending on your interaction with the Dealership and the types of communications you have requested or authorized.

DealerRock does not control the frequency of individual communications initiated by a Dealership except through functionality and controls made available within the DealerRock platform.

4. Message and Data Rates

Message and data rates may apply to SMS and MMS communications sent or received through the service according to the terms of your mobile service provider.

DealerRock and the Dealership are not responsible for charges imposed by your wireless carrier.

5. How to Opt Out

You may withdraw your consent to receive text messages at any time by replying STOP to a message.

Other commonly recognized opt-out requests may also be supported.

After you opt out, you may receive one final message confirming that your opt-out request has been processed. Except where otherwise permitted or required by law, no additional text messages will be sent under the consent you withdrew unless you later provide new consent.

Opting out of text messages does not prevent you from communicating with the Dealership using other methods.

6. Help

You may reply HELP to a text message for assistance.

For questions concerning a particular inquiry, transaction, appointment, service request, purchase, or other relationship with a Dealership, please contact the applicable Dealership directly.

Questions concerning DealerRock’s messaging technology, these Messaging Terms, or DealerRock’s privacy practices may be directed to privacy@dealerrock.com.

7. Wireless Carrier and Delivery Disclaimer

SMS and MMS delivery is subject to the availability and operation of wireless networks, telecommunications providers, messaging providers, devices, and other systems outside the control of DealerRock and the Dealership.

Wireless carriers are not liable for delayed or undelivered messages.

Neither DealerRock nor a Dealership guarantees that every message will be delivered or received within a particular period of time.

8. Your Mobile Number

You represent that the mobile telephone number you provide belongs to you or that you are authorized to provide the number and consent to communications to that number.

If you change, transfer, or discontinue your mobile telephone number, you should notify the applicable Dealership or opt out before discontinuing use of the number when reasonably possible.

9. Privacy

Information submitted through a DealerRock-powered messaging feature may include:

  • Your name;
  • Mobile telephone number;
  • Email address;
  • Message or inquiry content;
  • Communication history and replies;
  • Dates and timestamps;
  • Messaging consent and opt-out status;
  • Delivery and response information;
  • Website or page from which a request originated;
  • IP address, browser, device, and related technical information; and
  • Other information you choose to provide.

DealerRock generally processes this information on behalf of the applicable Dealership. The Dealership determines the purpose of the communication and how information relating to its customers, prospects, and communications is used, subject to applicable law.

The Dealership’s own privacy policy or privacy notice may also apply to information you provide and to the Dealership’s subsequent use of that information.

DealerRock’s privacy practices are described in the DealerRock Privacy Policy.

DealerRock does not sell or rent mobile telephone numbers, messaging consent records, or SMS opt-in information to third parties for their own marketing purposes.

DealerRock does not transfer an individual’s consent to receive text messages from one Dealership to another DealerRock customer.

10. Relationship With the Dealership

DealerRock provides technology used by Dealerships to communicate with their customers and prospects.

Unless DealerRock is expressly identified as the sender, communications sent through the DealerRock platform on behalf of a Dealership are communications from that Dealership.

The Dealership determines and is responsible for the content, purpose, recipients, and timing of communications it sends through DealerRock and for using DealerRock’s messaging services in accordance with applicable law.

Questions regarding products, pricing, inventory, appointments, service, transactions, financing, warranties, dealership policies, or other dealership matters should be directed to the applicable Dealership.

11. Dealership Responsibilities

Dealerships using DealerRock messaging services are responsible for:

  • Sending messages only when permitted by applicable law;
  • Obtaining and maintaining any consent required for communications they initiate;
  • Providing required notices and disclosures;
  • Accurately identifying themselves as the sender of communications;
  • Using customer information and messaging consent only for authorized purposes;
  • Honoring opt-out and revocation requests;
  • Not attempting to circumvent DealerRock’s messaging consent or opt-out controls;
  • Maintaining accurate contact and business information; and
  • Using DealerRock messaging services in compliance with applicable privacy, consumer protection, telecommunications, and marketing laws.

DealerRock may provide tools, controls, or technical safeguards designed to assist Dealerships in complying with these requirements, but each Dealership remains responsible for determining whether its communications and business practices comply with applicable law.

12. Acceptable Use

DealerRock-powered messaging services may not be used to transmit content or communications that are:

  • Unlawful or fraudulent;
  • Abusive, threatening, harassing, or harmful;
  • Defamatory or deceptive;
  • Sent without required consent or authorization;
  • Designed to evade opt-out requests, messaging restrictions, or provider requirements; or
  • Otherwise prohibited by applicable law, telecommunications provider requirements, or DealerRock policies.

DealerRock may restrict, suspend, or disable messaging functionality when reasonably necessary to protect recipients, DealerRock, its customers, telecommunications providers, or other parties, or to comply with applicable legal, carrier, security, or operational requirements.

13. Messaging Providers

DealerRock may use third-party telecommunications and infrastructure providers, including Twilio, to facilitate SMS and MMS communications.

Communications may therefore be transmitted, routed, processed, or stored through systems operated by DealerRock’s telecommunications providers and other service providers.

Availability, delivery, filtering, blocking, or other handling of messages may be affected by wireless carriers, telecommunications providers, messaging providers, recipient devices, network conditions, and other systems outside DealerRock’s control.

DealerRock may maintain records relating to messaging consent and communications, including:

  • The telephone number associated with the consent;
  • The applicable Dealership;
  • The date and time consent was provided;
  • The source or method through which consent was provided;
  • The disclosure or consent language presented when consent was provided;
  • Messaging history and related delivery information;
  • Opt-out requests;
  • The date and method of an opt-out request;
  • Subsequent consent or re-enrollment when applicable; and
  • Other information reasonably necessary to document messaging preferences and compliance.

DealerRock may retain these records as part of Customer Data and as reasonably necessary to provide the Services, enforce messaging preferences, document consent, address complaints or disputes, comply with telecommunications provider requirements, and satisfy applicable legal or contractual obligations.

15. Availability of Messaging Services

DealerRock may modify, suspend, restrict, or discontinue messaging functionality or particular messaging features when reasonably necessary for operational, technical, security, legal, telecommunications-provider, or regulatory reasons.

Messaging functionality may also be delayed, restricted, filtered, blocked, or unavailable due to circumstances outside DealerRock’s control.

16. No Guarantee of Response

Submitting a message through a DealerRock-powered website widget or messaging feature does not guarantee that a Dealership will respond or respond within a particular period of time.

DealerRock does not control dealership staffing, availability, inventory, pricing, business hours, sales practices, service availability, or response times.

For urgent matters, please contact the applicable Dealership using another available communication method.

17. Changes to These Messaging Terms

DealerRock may update these Messaging Terms to reflect changes in the messaging services, technology, legal requirements, telecommunications provider requirements, security practices, or DealerRock’s business practices.

When these Messaging Terms are updated, we will update the effective date at the top of this page.

If a change materially affects messaging practices or individual rights, DealerRock will provide any additional notice required by applicable law or contract.
